the Non-Academic Staff Association
(herein after called "NASA")
and
the Governors of the University of Alberta
(herein after called the "Board")
The following provisions shall apply with
regard to ratification and implementation of the new Part B: General Support Trust
Employees Agreement (herein after referred to as "Part B: Agreement") and shall
be effective the date of ratification unless stated otherwise:
1. The term of Part B: Agreement shall be
effective the date of ratification until March 31, 2000.
2. For General Support Trust Employees, the
parties agree to the salary grades and base pay rates as provided to General Support
Operating Employees (i.e., Part A: General Support Operating Employees Agreement, Appendix
A and B). The parties acknowledge that these salary grades and base pay rates are
currently in effect.
3. The parties agree that General Support
Trust Employees shall receive the same base pay increase, if any, on October 1, 1999,
(subject to the provisions of Part B: Agreement, Article 29 Exceptions to Terms and
Conditions of Employment) as General Support Operating Employees receive on October 1,
1999.
4. Within four (4) months of the date of
ratification, the Board shall provide notification to all current General Support Trust
Employees of their regular hours of work (i.e., as per a similar requirement in Part B:
Agreement, Clause 7.01).
5. The effective date of Part B: Agreement,
Article 12 Vacation shall be April 1, 1999. However, an employee who
completed five (5) years of continuous employment on or after April 1, 1998, will have
begun to earn vacation at the rate set out in Part B: clause 12.02(b).
6. The effective date of Part B: Agreement,
Article 18 University Credit Courses shall be April 1, 1999.
7. The effective date of Part B: Agreement,
Article 19 Human Resources Development shall be April 1, 1998.
8. The parties agree that the effective
date of implementation of Part B: Agreement, clause 17.03 shall be July 1, 1999. The
opting out provisions for clauses 17.03(a)(2) and 17.03(a)(3), as provided to NASA on
February 19, 1999, will be incorporated into the Benefits Booklet.
9. Pursuant to Part B: Agreement, clause
21.03, NASA agrees that Trustholders and the Board are not obligated to take immediate
action to initiate job evaluation for current positions; however, nothing prohibits an
employee from submitting a review under Article 21 Position Evaluation.
10. The parties acknowledge that on the
date of ratification there will be anomalies between the new provisions of the Part B:
Agreement and the terms and conditions of employment for some current employees. The
parties hereby agree to allow current anomalies without initiating the process set out in
Part B: Agreement, Article 29. However, a current general support trust employee (or with
a NASA representative) who believes s/he has anomalous terms or conditions may request
that the Trustholder comply with the new provisions of the Part B: Agreement. Trustholders
may access the advice of Employee Relations on matters of this nature. If the Trustholder
is unable to comply with the request, the process established in Part B: Agreement,
Article 29 will then apply. All future exceptions shall be processed in the agreed upon
manner of Part B: Agreement, Article 29.
11. The parties agree that the outstanding
complaints/grievances outlined in Appendix A with regard to general support trust
employees are hereby resolved and as such these complaints/grievances are hereby
withdrawn.
12. The parties agree to reach agreement
upon the individuals or positions identified and listed in Part B: Agreement, Appendix J
by no later than June 30 1999.
13. The parties agree that current
employees who would have been eligible in December 1997 for paid days off pursuant to the
provisions of Part B: Agreement, Article 11 Winter Closure Days and who did not
actually receive those paid days off shall have a reconciliation made for any lost
entitlements.
14. As soon as reasonably possible after
ratification by the parties, the Board agrees to transfer the amount of all money,
including interest, held in trust by the Board (i.e., the dues that were
deducted from general support trust employees from January 1997) to NASA. NASA hereby
agrees to release and discharge the Board from any and all claims for dues payment for any
time prior to January 1997.
16. The members of the negotiating teams
agree to publicly support and endorse these new agreements (including Part B: Agreement)
to all employees, Trustholders and the University community.
17. The parties agree that by ratification
of Part B: Agreement, by signing of the Memorandum of Agreement - Part C: Consolidated
Collective Agreement Bargaining Process and by signing of the Memorandum of Agreement
The Structure of the Consolidated Collective Agreement, all previous agreements
between the parties on these matters shall hereby be superceded and replaced.
18. The parties agree to write to
all appropriate bodies to notify each of the resolution of all these matters and to the
withdrawal of all outstanding requests, applications, grievances or complaints (as set out
in appendix A) or claims.

(herein after called "Board")
and
the Non-Academic Staff Association
(herein after called "NASA")
This Memorandum of Agreement shall form part of the
Collective Agreement between the Governors of the University of Alberta and the
Non-Academic Staff Association.
STRUCTURE OF THE CONSOLIDATED
COLLECTIVE AGREEMENT
1. In accordance with Appendix T of
the 1997-2000 Board/NASA Collective Agreement between the Board and NASA, the parties
agree to include the negotiated terms and conditions of employment for general support
trust employees as part of a Consolidated Collective Agreement.
2. The Public Service Employees Relations
Act applies to the University of Alberta, and general support staff of the University of
Alberta.
3. The specific terms and conditions of
employment that apply to general support operating employees shall be constituted in the
Consolidated Collective Agreement as:
Part A General Support Operating Employees
Agreement
4. The specific terms and conditions of
employment that apply to general support trust employees, upon ratification by the
parties, shall be constituted in the Consolidated Collective Agreement as:
Part B General Support Trust Employees
Agreement
5. The parties agree that the provisions
regarding the collective bargaining process, shall be constituted in the Consolidated
Collective Agreement as:
Part C Consolidated Collective Agreement Bargaining Process
Agreement
6. The parties agree that all current
provisions of Article 44 of the 1997-2000 Board/NASA Collective agreement shall be null
and void upon signing of this document and replaced by this Memorandum of Agreement and
the Memorandum of Agreement on Part C Consolidated Collective Agreement Bargaining
Process.
7. The new Consolidated Collective
Agreement shall consist of Part A, Part B, and Part C.

This Memorandum of Agreement shall form
part of the new Consolidated Collective Agreement between the Governors of the University
of Alberta and the Non-Academic Staff Association and shall supercede and replace the
collective agreement bargaining process outlined in Article 44 of the 1997-2000 Board/NASA
Collective Agreement.
PART C - CONSOLIDATED COLLECTIVE
AGREEMENT BARGAINING PROCESS
1. Term of the Collective
Agreement
Unless otherwise expressly provided herein,
the Consolidated Collective Agreement shall take effect April 1, 1997, to March 31, 2000.
The Consolidated Collective Agreement shall remain in effect thereafter until a
replacement Consolidated Collective Agreement comes into force.
Part A - General Support Operating
Employees Agreement of the Consolidated Collective Agreement shall take effect April 1,
1997, to March 31, 2000.
Part B - General Support Trust Employees
Agreement of the Consolidated Collective Agreement shall take effect on the date of
ratification, except as otherwise may have been agreed to between the parties, to March
31, 2000.
Part C Consolidated Collective
Agreement Bargaining Process Agreement of the Consolidated Collective Agreement shall take
effect on the date of signing by the parties to March 31, 2000.
2. Notice to Commence Collective
Bargaining
Notice for the purpose of this Consolidated
Collective Agreement will be addressed in the case of the Board to the Associate Vice
President (Human Resource Services), or in the case of NASA to the Designated Official of
NASA.
3. Composition and Mandate of the
Negotiating Committee
(a) After notice to commence collective
bargaining has been served by either party, the parties shall each appoint their
negotiation committees that normally consists of up to four (4) employees.
(b) The negotiating committees shall be
appointed for the purpose of negotiating terms and conditions of employment for the
Consolidated Collective Agreement (i.e., Part A, Part B and C).
4. Collective Bargaining Process
The specific bargaining process undertaken
and any issues of procedure will be determined prior to the formal commencement of
negotiations. The parties agree that an interest-based approach to collective bargaining
is supported as one viable method for collective bargaining.
5. Collective bargaining and disputes shall
be governed in accordance with the provisions of the Public Service Employees Relations
Act or as otherwise may be agreed to between the parties.
6. The Board agrees to provide to NASA such
available statistical information, relating to employees in the bargaining unit and
pertaining to the provisions of the Consolidated Collective Agreement, provided the
release of the information is not in violation of any legislation, and provided the cost
involved is borne by the NASA, at the option of the Board.

Negotiations
This is to confirm that the parties
have agreed that the introduction of co-payment of premiums and opting-out benefits for
part-time general support trust employees is:
a) an improvement over current conditions
for part-time general support trust employees; and
b) will not set a precedent or be a
justification for the introduction of co-payment of premiums and opting-out benefit
programs for the next set of trust negotiations.
