A study of Vancouver businesses conducted by the law firm, McAulay McColl LLP revealed that while only 8% of disputes were solved by mediation and arbitration, two forms of Alternative Dispute Resolution (ADR), “a majority of the respondents found ADR moderately effective in delivering important benefits such as saving time and money, preserving relationships and protecting confidentiality” more. In fact, more than “70% of respondents to the survey indicated a savings of 50% in legal costs using mediation with over 38% experiencing similar savings for arbitration”.

Litigation is consistently shown to be a long and expensive process and it can have very negative effects on the relationship and confidentiality of the parties involved.
